Wrongful Death Claims in Florida
Wrongful death claims are civil cases that pursue damages in the form of monetary compensation. They can be sought even if the at-fault party has been charged with a crime and is being prosecuted in search of jail time and other penalties. Civil and criminal cases are two separate matters. They also differ in that a wrongful death claim only needs to be proven by a “preponderance of evidence” as opposed to the high bar of “beyond a reasonable doubt” in criminal courts.
Wrongful death claims can occur based on:

Damages in Wrongful Death Claims
Two categories of damages may be pursued under wrongful death claims: 1. Damages for the family and 2. Damages for the deceased person’s estate.
Family damages can include:
- Loss of services, support, companionship, and protection that the decedent would have provided
- Pain and suffering of the family
- Loss of parental guidance and companionship for the decedent’s children
- Medical expenses paid by the family
- Funeral and burial expenses paid by the family
Estate damages can include:
- Loss of the decedent’s wages, earnings, or benefits
- The value of savings that would have become part of the estate if the decedent had lived based on his or her earnings and benefits
- Medical and/or funeral expenses paid by the estate
